What state insurance departments do for consumers

Each state has a Department of Insurance (also called a Division of Insurance or Commissioner of Insurance). These agencies regulate Medigap (Medicare Supplement) insurance policies sold by private insurers in their state. They also license and oversee insurance agents, handle consumer complaints against insurers and agents, and provide information about insurance rights and protections.

State departments vs. other resources

State Insurance Department: Regulates insurers, agents, and policies. Handles complaints about Medigap policies, Medicare Advantage marketing practices, and agent behavior in your state.

State Health Insurance Assistance Program (SHIP): Free, independent counseling about all Medicare options, enrollment questions, and appeals. See SHIP Directory for your state.

Medicare Beneficiary Ombudsman: Helps resolve Medicare-specific issues and complaints. Call 1-800-MEDICARE (1-800-633-4227) to submit issues that haven't been resolved locally.

Centers for Medicare & Medicaid Services (CMS): Oversees Medicare and Medicare Advantage nationwide. File complaints at Medicare.gov.

Finding your state insurance commissioner

The National Association of Insurance Commissioners (NAIC) maintains the official directory of all U.S. state insurance commissioners and departments. Their website includes state-by-state links, consumer resources, and a directory you can search or download.

Most state insurance departments now have dedicated consumer hotlines and online complaint forms on their websites. When you visit your state's site, look for:

Before contacting your state insurance department, confirm the current information on your state's official website or the NAIC directory. If you cannot reach the number listed, calling your state's main information line can direct you to the insurance department's consumer unit.
